Welcome to The Coco Candle Company (“Coco Candles,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website, www.cococandles.co, our products, and related services.

By using this website or placing an order, you agree to these Terms. If you do not agree, please discontinue use of the website.

1. Use of the Website

You may use this website only for lawful browsing and purchasing purposes.

You agree not to:

  • Engage in fraudulent, false, or misleading activity

  • Interfere with website functionality, security, or performance

  • Copy, resell, scrape, or misuse website content

  • Use automated tools, bots, or scraping technology

  • Attempt to gain unauthorized access to our website, systems, or customer information

  • Use the website in a way that harms our business, customers, reputation, or brand

We reserve the right to refuse service, cancel or decline any order, restrict access, or take any other appropriate action at our sole discretion, for any reason or no reason. This includes, but is not limited to, situations where we believe these Terms have been violated or where activity appears fraudulent, abusive, or harmful. If we cancel an order that has already been paid for, we will issue a full refund to the original payment method.

2. Product Information and Availability

We make reasonable efforts to accurately describe our products, materials, fragrances, pricing, sizing, and product details.

However, because our products are small-batch and handcrafted, slight variations may occur, including but not limited to:

  • Color

  • Texture

  • Finish

  • Wax appearance

  • Fragrance strength or scent experience

  • Label or packaging placement

Fragrance experience may also vary based on room size, airflow, temperature, environment, product care, and individual scent perception.

Product availability may change without notice. We reserve the right to modify, discontinue, or limit quantities of any product at any time.

3. Pricing and Payments

All prices are listed in U.S. Dollars.

We reserve the right to:

  • Update pricing at any time

  • Correct typographical, pricing, or system errors

  • Cancel, decline, or refuse any order at our sole discretion, for any reason or no reason

  • Cancel or refuse orders impacted by pricing, product, or system errors

  • Cancel or refuse orders suspected of fraud, abuse, or unauthorized activity

Where we cancel a paid order, a full refund will be issued to the original payment method. We are not obligated to provide a reason for any cancellation or refusal.

By placing an order, you confirm that:

  • Your payment details are valid and authorized

  • You are permitted to use the selected payment method

  • The billing and shipping information provided is accurate

  • You are legally authorized to complete the transaction

Payments are processed through secure third-party payment providers. We do not store full credit card numbers on our website.

4. Shipping and Delivery

Shipping timeframes are estimates and may vary based on:

  • Carrier or postal delays

  • Seasonal order volume

  • Weather or environmental conditions

  • Holidays

  • Incorrect or incomplete shipping information

  • Circumstances outside of our control

Customers are responsible for providing accurate shipping details at checkout.

Once an order has been shipped, Coco Candles is not responsible for delays, delivery errors, lost packages, stolen packages, incorrect delivery scans, or other shipping issues caused by the carrier or inaccurate customer-provided information.

If a package is returned to us due to an incorrect or incomplete address, refusal, failed delivery attempt, or other customer-related issue, the customer may be responsible for additional shipping costs.

If your order is significantly delayed or appears lost, please contact us and we will do our best to assist with the carrier claim process where available.

5. Returns, Exchanges, and Order Issues

Due to the handmade nature of our products and the personal-use nature of candles and home fragrance items, all sales are final.

Coco Candles does not accept returns, exchanges, or cancellations once an order has been placed, unless otherwise required by law.

We do not accept returns or exchanges for:

  • Change of mind

  • Fragrance preference

  • Used, opened, burned, sprayed, or altered products

  • Product misuse

  • Failure to follow care or safety instructions

  • Delayed packages caused by the shipping carrier

  • Lost or stolen packages after carrier-confirmed delivery

  • Incorrect or incomplete shipping information entered by the customer

Damaged, Defective, or Incorrect Orders

If your order arrives damaged, defective, or incorrect, please contact us within five (5) days of delivery at hello@cococandles.co.

Please include:

  • Your order number

  • A description of the issue

  • Clear photos of the product

  • Clear photos of the packaging and shipping box

We will review the issue and determine whether a replacement, refund, or store credit is appropriate.

Coco Candles reserves the right to deny claims that are incomplete, submitted after the stated timeframe, unsupported by photos or order details, or caused by customer misuse, improper handling, or failure to follow product care and safety instructions.

6. Candle Safety and Usage Disclaimer

Our products must be used responsibly and in accordance with all included care and safety instructions.

For candles, you agree to follow standard candle safety practices, including but not limited to:

  • Never leave a burning candle unattended

  • Keep candles away from children and pets

  • Keep candles away from drafts, curtains, papers, furniture, bedding, and other flammable materials

  • Burn candles only on a stable, heat-resistant surface

  • Trim the wick before each burn

  • Do not burn candles longer than the recommended burn time

  • Do not move a burning candleStop use when approximately 1/2 inch of wax remains

  • Do not use a candle if the vessel is cracked, chipped, or damaged

Coco Candles is not liable for damage, injury, loss, or claims resulting from:

  • Unattended or unsafe burningFailure to follow safety instructions

  • Use near flammable materials, children, or pets

  • Improper handling, storage, or use

  • Product misuse or alteration

  • Use of products for anything other than their intended purpose

Consumers agree to exercise reasonable care when using our products.

7. Home Fragrance Product Safety

If we offer room sprays, linen sprays, reed diffusers, wax melts, or other home fragrance products, those products must be used only as directed.

You agree to:

  • Keep fragrance products away from children and pets

  • Avoid contact with eyes, mouth, skin, finished surfaces, painted surfaces, plastics, leather, and delicate fabrics unless otherwise stated

  • Do not ingest products

  • Do not spray near open flames or heat sources

  • Test sprays on a small, hidden area before use on fabrics or surfaces

  • Use products only for their intended purpose

Coco Candles is not responsible for damage, stains, allergic reactions, irritation, injury, or loss resulting from misuse, improper application, failure to follow instructions, or individual sensitivities.

8. Allergies and Sensitivities

Our products may contain fragrance oils, waxes, botanicals, colorants, essential oils, carrier ingredients, or other materials that may cause sensitivity in some individuals.

Customers are responsible for reviewing product details before purchasing and using products responsibly.

Discontinue use immediately if irritation, discomfort, headache, breathing difficulty, or any adverse reaction occurs.

Coco Candles does not provide medical advice and is not responsible for individual allergic reactions, sensitivities, or personal health responses to fragrance products.

9. Intellectual Property

All branding, logos, product names, product descriptions, text, photography, graphics, designs, website content, and related materials are the property of Coco Candles unless otherwise stated.

This content is protected under applicable Georgia and U.S. intellectual property laws.

You may not copy, reproduce, modify, distribute, resell, publish, display, or use our content without prior written permission.

10. Third-Party Links and Services

Our website may reference or link to third-party websites, platforms, tools, payment processors, shipping providers, email services, or other outside services.

Coco Candles is not responsible for:

  • Third-party content

  • Third-party policies

  • Third-party privacy practices

  • Third-party service interruptions

Accessing third-party websites or services is at your own discretion and subject to the terms and policies of those third parties.

11. Promotions, Discounts, and Gift Cards

Promotions, discount codes, sales, and special offers may be changed, limited, or discontinued at any time.

Discounts cannot be applied retroactively unless we choose to do so at our sole discretion.

Only one discount or promotion may be used per order unless otherwise stated.

Gift cards, if offered, are not redeemable for cash except where required by law.

12. SMS/Text Messaging Terms

By opting in to receive text messages from The Coco Candle Company, you agree to receive SMS/MMS text messages from us at the mobile phone number you provide.

Text messages may include, depending on the consent you provide, order updates, shipping or pickup coordination, customer service messages, product availability updates, restock alerts, promotions, seasonal release announcements, product launch updates, brand updates, and other Coco Candle Co. marketing communications.

Consent to receive marketing text messages is not a condition of purchase. You may still purchase products from Coco Candles without opting in to marketing text messages.

Message frequency varies. Message and data rates may apply. Message delivery is subject to carrier availability and is not guaranteed.

You may opt out of receiving text messages at any time by replying STOP. After you reply STOP, you may receive one final confirmation message confirming that you have been unsubscribed.

You agree to provide a valid mobile phone number that you own or are authorized to use. You agree not to provide someone else’s phone number without permission.

Coco Candles is not responsible for delayed or undelivered text messages, carrier issues, mobile device settings, incorrect phone numbers, or other issues outside of our control.

13. User Content and Reviews

If you submit reviews, photos, testimonials, comments, messages, or other content to Coco Candles, you confirm that the content is accurate, lawful, and does not infringe on the rights of others.

By submitting content, you grant Coco Candles permission to use, display, repost, share, or reference the content for marketing, website, social media, customer service, or promotional purposes.

We reserve the right to remove or decline to publish content that is false, offensive, misleading, inappropriate, or harmful to our business or customers.

14. Limitation of Liability

To the fullest extent permitted under Georgia law, Coco Candles is not liable for:

  • Indirect, incidental, special, or consequential damages

  • Loss of revenue, business opportunity, goodwill, or data

  • Claims arising from misuse, improper handling, or unsafe use of products

  • Shipping delays or carrier-related delivery issues

  • Individual fragrance preferences, sensitivities, or allergic reactions

  • Damage caused by failure to follow care, safety, or use instructions

Our total liability for any claim shall not exceed the purchase price of the applicable order.

Nothing in these Terms is intended to limit rights that cannot be limited under applicable law.

15. Indemnification

You agree to indemnify and hold harmless Coco Candles, its owners, employees, contractors, vendors, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from:

  • Your misuse of the website

  • Your misuse of our products

  • Your violation of these Terms

  • Your violation of applicable laws

  • Your infringement of intellectual property or other rights

  • Any content, information, or materials you submit to us

16. Governing Law and Venue

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles.

Any disputes arising from or related to these Terms, the website, or purchases from Coco Candles shall be resolved in courts located in Gwinnett County, Georgia, unless otherwise required by applicable law.
